Alexander McCausland of Ardstragh in the Barony of Strabane & County of Tyrone Esq by his will of this date bequeathed. First to his wife Jennett McCausland Half of his ? for her life. To his son Oliver McCausland the other half and the lands of Ardstragh and half of Mountfield. The other half to his son Andrew also £150 English Money and also Eskerdon to him & his Heirs. To Andrew also Aldohill and Ballykill. To his Daughter Ann McCausland £150 English Money. To his Grandchildren Alexander Colhoun & Gerrard Colhoun £100. Children of his daughter Katherine by his son in law William Colhoun.

 

Testator had another daughter Margery McClenaghen.

 

He appoints William Colhoun of Newtown Stewart, David McClenaghen of the same his son in law & Oliver McCausland his son his only executors or any two of them.

I Oliver McCausland of Strabane Co. Tyrone Esq do make this my last will &c &c. I bequeath my Manor of Stranorlar &c in Bar: Raphoe Co. Donegal & my share of the Manor of Castlequin, said Bar: & Co – also my dwelling house in Strabane &c & the ¼ land of Ballycolman &c in Par: Urney Co. Tyrone &c to my eldest son John McCausland – with jointure to his present or other wives – in tail to my grandson Oliver McCausland (eldest son of John) & heirs male, reversal to 2nd 3rd &c sons of John & heirs male, - & failing such to my 2nd son William McCausland & his heirs male, & failing such, to my 3rd son Oliver McCausland & his heirs male, & failing such, to the issue female of John, then of Wm & then of Oliver &c &c &c –

 

I leave my Manor of Mountfield &c also the townland of Rash &c both in Bar: Strabane Co. Wilson, Jas Willy, Jas Young, Malcolm Henry and Nathan Carr, all then in possession for 19 years with a clause of renewal every 7 years, as often as he....himself with the Bishop.  That said, Malcolm Henry, Margaret Wilson, Jas Young, Jas Willy and Nathan Carr, about 1720 assigned their interest to Pts. Jn. Wilson, Thos Matthewson & John Love and emigrated to America.  Suit is to compel Plts. To renew.

Tyrone, Esq, and John McCausland third son of said Alex­ander McCausland, of the one part, and Wil­liam Hamilton of Calledon in sd Co. of Tyrone, clerk Archdeacon of Armagth and Oli­ver McCausland of Rush in sd Co. of Tyrone, Esq, of the other part; and the Release being an In­den­ture Tri­par­tite made be­tween said Alex. I Oliver McCausland of Strabane Co. Tyrone Esq &c do make this my last will - &c &c &c. My debits to be paid out of the rents of my estate in the Manor of Mountfield Co. Tyrone. I bequeath to my dear wife Rachel McCausland £100 per an for life &c &c &c. I also bequeath to my said wife Rachel my household furniture, chair horses & other cattle save the chestnut horse, my riding furniture & pistols which I bequest to my brother-in-law Mr. John Hamilton.

 

I bequeath to my wife Rachel &c. all my real &c Estate viz. the lands &c of the estate of the Manor of Mountfield the freehold of Rash, the lease & lands of Ardstra &c &c for the use of my dau: Rose McCausland & the heirs male of her body & failing, to the heirs female & failing such to my nephew Alexander McCausland & his heirs &c for ever - &c &c –

Declaration of Trust dated 1 November 1755 between Jno McCausland, Drumragh, County Tyrone, Gent. Reciting as therein recited that whereas by Marriage Article or Instrument in writing made on the intermarriage of William McCausland son of the said Jno McCausland with Jane Birney daughter of John Birney of Omagh, County Tyrone and dated 13 december 1729 made between the said Jno Birney of the one part to the said Jno McCausland as a Trustee of the other part. The said John Birney did thereby made over unto the said William and Jane amongst other things inconsideration the said Marriage the full issues, Profits, Benefits and Advantages of the house possessed by James Stewart in the town of Omagh for 10 years. And the said house to them and the said William and Jane and their lawful issue for ever subject to a yearly rent of 20/ sterling. And by an Article in writing to the said Article annexed witnessed by William Birney eldest son and heir of said Jno Birney and by Abraham Birney of Omagh bearing date 2 January 1729. The said Wm. And Jane and their lawful children and by a Bond of Formance dated 5 January 1729 said Jno Birney did cont (Covenant?) the penalty of 100 sterling (to?) assure said Rents and Profits.

 

The said William McCausland intermarriage aforesaid together with House, Tenement, garden and backstable. And also by a Deed bearing the date 19 May 1742 did make over the said Premises to John and Robert McCausland children of the Said Wm and Jane and reciting also that the said Jno McCausland first above named was made a Party to the said several writing above recited. As a Trustee to the said Wm and Jane and their lawfully begotten between them... said John McCausland did acknowledge publich and declare that his name was and is made use of in the said several writings in Trust for the said Wm and Jane and their issue... The said John McCausland the Trustee in the presence of Alexander McCausland of ( ) and Edward Morris of Strabane both County Tyrone, Gent and this Memorial was executed by said Jno McCausland in the presence of said Abraham McCausland and Edward Morris, Justice of the Peace for County Tyrone this 1st day of November 1755 at Newtownstewart, County Tyrone...

A memorial of a Penalty of Condition dated the 4 November, 1764 and entered into Between John and Patrick McCausland of Drenagh and County of Tyrone for themselves their heirs Educational Advisors and assigns in the pural Sum of one Hundred & fifty pounds its good & lawful money of Great Britain each to pay to the other or any of theirs Who shall not stand or abide by the award made by Alex McCausland James Fuitor & Thomas Caldwell which is contained on the amt side of the Bond and is relative to the Divison of their lands as appear by said unting and the said Bond is withheld by the said Alex McCausland of Gortuacrea and the said Thomas Caldwell of Drummaboth in the County of Tyrone farmer and his Memorial is also witnessed by Thomas Caldwell & John Baxter of Omagh.

Mary Bacon shall be then living IN TRUST and to the intent and purpose that the said Hugh Hill and Connolly McCausland and their heirs and assigns do and shall permit and suffer the said Mary Bacon and her assigns yearly and every year during her Natural Life, as well during the life of the said Marcus McCausland after his Death anything herein before contained in anywise notwithstanding to receive and take to her and their own use and uses, the whole of the Rents, issue and Profits of the said Lands of Edinmore with full powers to destine for the same and take all other legal means for Recovery thereof. And after the Death of the said Dominick McCausland and Mary Bacon and the Survivors of them... to permit and suffer the issue of the said Dominick and Mary whether male or female to receive and take the rents, issues and profits of the said Lands in such manner at such time, and in such shares and proportions as he the said Dominick McCausland shall by any Deed in his lifetime attested by two or more Credible Witnesses or by his last will and testament in writing executed in the presence of three credible witnesses direct limit and appoint, And for want of such appointment to permit and suffer all the said Children male and female and their Heirs and assigns to receive and take the rents, issues and profits of the said Lands in equal share and proportions during the Remainder of the said Term And if there shall happen to be but one Child then to permit and suffer such Child whether male or female and his and her Heirs and assigns... to receive and take the whole thereof, And if there shall happen to be no Child of the said Dominick McCausland on the Body of the said Mary Bacon begotten then TO the use and behoof the said Dominick McCausland his heirs and assigns and to and for no other use intent or purpose whatsoever, DID as for and concerning the said sum of one thousand pounds the Marriage portion of the said Mary Bacon His hereby covenanted and agreed upon by and between the parties to these presents and declared to be their True intent and meaning that the same is... hereby vested in the said Robert Campbell and James Stirling their Escors Admors and assigns for the Trusts, uses and purposes hereafter mentioned that is to say that from and immediately after the said intended Marriage shall take effect the said Dominick McCausland shall........ Receive and take to his own proper Use during his Life the Yearly interest of the said One thousand pounds the same to be paid to him or his assigns by the said Robert Campbell and James Stirling or the Survivor of them and the Exors Admors and Assigns of such survivors in such Gales and Payments as they shall from time to time receive the same and from and immediately after the Death of the said Dominick McCausland that the said Mary Bacon in Case she survives the said Dominick McCausland shall have receive and take the yearly interest of the said One thousand pounds during her life in manner aforesaid and from and after the Death of the survivor of the said Dominick McCausland and Mary Bacon then the said sum of one thousand pounds and all interest that then or may thereafter grow due thereon shall go to the Children of the said Marriage Male or Female in such shares and proportions as the said Dominick McCausland shall by any Deed to be by him duly executed in his life Time in the presence of two Credible witnesses or by his last Will and Testament duly executed in the presence of the like Number of two Credible Witnesses direct and appoint and for want of such appointment the said one thousand pounds and interest to be paid to and among the Children of the said Marriage in equal shares and proportions and to be paid to such of the said Children as shall be a Son or Sons at his or their respective Ages of twenty one years and to such of them as shall be a Daughter or Daughters at her or their respective Ages of Twenty one years, or Days of Marriage which shall first happen and in case there be but one Child by the said Marriage then the whole of the said One thousand pounds and interest to go and be paid to such Child at the Time aforesaid PROVIDED always and it is True intent and meaning of these presents and the party hereto... that if it shall happen there be no Child or Children by the said Marriage that the said Mary Bacon shall dye in the life time of the said Dominick McCausland, that then and in such Case the said One thousand pounds and interest shall go, and be paid to the said Dominick McCausland his Exors Admors and Assigns and to his and their own use forever, and in like manner if the said Dominick McCausland shall dye in the Lifetime of the said Mary Bacon leaving no Child or Children by her that then the whole of the said One thousand pounds and interest shall go and be paid to the said Mary Bacon her Exors Admors and Assigns and to her and their use forever AND it is hereby further concluded and agreed upon by and between all the said parties to these presents that whenever the said Sum of one thousand pounds which is now out at interest on the Bond of THE REV. BENJ. BACON party to these presents.... shall to be paid then and in that Case the said Robert Campbell and James Stirling and the survivor of them and the Exors Admors and Assigns of such survivor shall with all convenient speed Lend and place out the same at Interest by and with the consent and Approbation of the said Dominick McCausland upon the Trusts aforesaid and so from time to time with such consent and approbation shall call in and receive the money so lent or placed out, or any part thereof, and again to Lend and place out the same in Manner and upon the Trusts aforesaid PROVIDED always and that in Case the said Dominick McCausland shall at any time here after think it more advantageous to lay out the said Sum of one thousand pounds in the Purchase of any Land that then and in such Case with the consent approbation of the said Robert Campbell and James Stirling or the Survivors of them or the Exors Admors and Assigns of such Survivor he the said Dominick McCausland shall have full power and Authority to apply the same in the making such purchase and the Lands so purchased shall be and are here by declared so far as the said One thousand pounds shall go to and ensure to the uses and purposes herein before appointed relating to the

 

THIS INDENTURE made the second.... day of January in the year of our Lord one thousand seven hundred sixty nine (2 Jan 1769). BETWEEN Marcus McCausland of Daisyhill in the County of London Derry Esquire and Dominick McCausland son of the said Marcus McCausland of the first part, The Reverend Benjamin Bacon of Glebe Hall in said County of Londonderry Doctor in Divinity and Mary Bacon, Daughter of the said Benjamin Bacon of the second part. Hugh Hill of the City of Londonderry Esquire and Connolly McCausland of Fruithill in said County of Londonderry Esquire of the third part, Robert Campbell of Newtown Limavady and James Stirling of Walworth, both in said County Esquires of the fourth part.

 

WHEREAS a Marriage is intended to be shortly had and solemnized between the said Dominick McCausland and the said Mary Bacon AND WHEREAS the said Benjamin Bacon hath agreed to give the sum of one thousand pounds sterling as a marriage portion with his Daughter the said Mary to be settled in manner as herein after mentioned AND WHEREAS the said Marcus McCausland is seized and possessed of the Town and Lands of Edenmore situate in the said County of Londonderry under and by virtue of and Indenture of Lease there of made to the said Marcus McCausland by the Right Honorable Marcus late Earl of Tyrone bearing date the Thirtieth day of April One Thousand Seven Hundred and forty six (13 April 1746).... for and during the life and lives of the said Marcus McCausland or the Term of thirty one years to be computed from the first day of November then last past which whichever shall last longest And the said Marcus McCausland in order to make a provision for his said son and the said Mary his intended wife, in case she shall happen to survive him and the issue of said Marriage hath agreed to Convey all his Right Title and Interest in the said Town and Lands of Edenmore to and for the several Uses. Trusts intents and purposes herein after mentioned NOW THIS INDENTURE WITNESSETH that the said Marcus McCausland for the purposes aforesaid and in consideration of the said intended Marriage and of the sum of one thousand pounds the Marriage portion of the said Mary in hand paid or secured to be paid by the said Benjamin Bacon to the said Robert Campbell and James Stirling at or before the sealing of these presents for the purposes herein after mentioned the Receipt whereof they and each of them do hereby acknowledge and in consideration of the sum of five shillings sterling. To him the said Marcus McCausland in hand paid by the said Hugh Hill and Connolly McCausland the receipt whereof he the said Marcus McCausland doth hereby acknowledge HATH granted, bargained sold, assigned, transferred and made over by these presents DOTH grant bargain sell assign transfer and make over unto the said Hugh Hill and Connolly McCausland in their actual possession now being by virtue of a Bargain and Sale to them thereof made for one year by indenture bearing date the Day before the Day of the Date of these presents and by force of the Statute for Transferring uses into Possession and to their heirs FOR THAT AND THOSE the said Town and Lands of Edemore with all and singular the Rights members and appurtenances whatsoever thereunto belonging or in anywise appertaining in as full and ample manner as the same are herein before mentioned to be Demised by the said herein before recited Leave and as the same have been held and enjoyed by the said Marcus McCausland situate lying and being in the County of Londonderry aforesaid and all the Estate. Rights, Title, Interest, Trust, Term, Property, claim and Demand whatsoever of him the said Marcus McCausland of in and to the same and every part thereof, and the Rents, Issues and profits of the said premises and every part and parcel thereof. TO HAVE AND TO HOLD all and singular the said Lands and premises with their appurtenances as aforesaid unto the said Hugh Hill and Connolly McCausland their heirs and assigns for and during the natural Life and Lives of the said Marcus McCausland, Robert McCausland and Hercules McCausland and the longest liver of them and for and during the rest, residue and Remainder of the said Term of Thirty one years, yet to come and unexpired to be computed from the said First Day of November then last.... Subject to the Rents and Covenants in and by the said recited Lease on the Lessees part to be paid and performed, In Trust Nevertheless and for the several uses intents and purposes herein after expressed and declared to be concerning the same. That is to say IN TRUST to the use of the said Marcus McCausland and his heirs until the said intended Marriage shall be had and solemnized and from and after the Solemnization thereof IN TRUST That they the said Hugh Hill and Connolly McCausland their heirs and assigns so and shall permit and suffer the said Dominick McCausland and his Assigns to receive and take the Rents, Issues and profits of that part of the said Lands of Edenmore now in the possess of Edward Reiley Senior, Edward Reiley Junior, John Reiley and Cath. McFall widow for and during the natural Life of the said Dominick McCausland, And in Trust to permit and suffer the said Marcus McCausland and his assigns to Receive and take the rest Residue and Remainder of the rents issues and profits of the said Lands for a during the Joint Lives of him the said Marcus McCausland and Dominick McCausland and from and immediately after the death of the said Marcus McCausland. "To be sold by auction in the town of Omagh and Country of Tyrone on the twenty-first day of March inst. the following freeholds and chattel leases the property of Alex. McCausland late of Corranarry, Esq., dec. pursuant to his will, viz.

 

The Townland of Corranarry. This is a lease for 21 years from May, 1773, subject to £24 per annum and agent's fees; in a remarkable good farm containes 40A. or thereabouts, abounds with meadow well watered and sheltered with plenty of bog.

 

The Townland of Cummery. This is the like tenure; it contains 129A, 1R. 3p. arable pasture and bog adjacent to £30 per annum and agent's fees and if divided into four parts is meadow and bog enough to supply each.

 

The profit rent of Lisanelly. This is for one life and pays annually £3.10.0 to the heirs of Mr. McCausland. The above lands lie in the Parish of Cappagh near Omagh.

 

The great holm, castle, hill and field. This is lease for the life of Mr. William McCausland, contains 25A or thereabouts subject to £20 per annum only and is mered and bounded by the river and great road leading from Omagh to Strabane.

 

The large house, offices and garden now inherited by the heirs of James Maxwell, Esq., deceased standing near the Session House in the town of Omagh.

 

Aforesaid; this is a deed forever, but set for one or two lives at the yearly rent of £6.13.0.

 

A waste plot of ground adjoining the Session House and Mr. Maxwell's house, containing near an acre, unset, and would be very convenient for building thereon, having two fronts and ground for offices and gardens; this is a deed forever.

 

The fields adjoining the new Meeting House, containing 8A. or thereabouts not more than one hundred yards from the town; this is a deed forever, the fields set from year to year to Mr. Maxwell.

 

The new Meeting House. This is a deed forever and set by Mr. McCausland to the congregation at £1.10.0 per annum forever.

 

The ground rent of Alex. Kerr's houses. This is a deed forever, and set to Kerr for 10s. per annum forever.

 

The house inhabited by Owen Moss in the front street of the town of Omagh opposite the Session House. This is a deed forever and set for £3.0.0 per annum forever.

 

The ground rent of the houses now inhabited by William McConetry merchant being a deed forever of 13s per annum.

 

The ground rent of the house adjoining it, inhabited by John Brown. This is a deed forever, set for 6s.8d. forever.

 

The house inhabited by Charles Johnston, butcher. This is a deed forever set during an old man's life for 20s. per annum.

 

The house inhabited by John Robinson. This is a deed forever but set during an old woman's life upwards of 80 at £1.12.6 per annum.

 

The house inhabited by Dennis McCavell: this is a deed forever, and now set year by year at £1.10.0 as no lease could be granted longer.

 

The houses held by Charles Anderson being inhabited by John Stockwall, Mr. McAlear, and others; this is a deed forever and set for £4.0.0. per annum forever.

 

The house, large garden, offices and park formerly inhabited by Mrs. Crawford. This is a deed forever unset and would answer a distiller.

 

The ground rent of the two houses next adjoining the same, being newly built by C. Crawford. This is a deed forever and set for £1.0.0 forever.

 

The ground rent of the two houses next adjoining them being a deed forever and set to Mr. David Campbell, merchant, at £1.10.0. per annum forever.

 

The above lie in and near the town of Omagh.

 

There will be six months credit on approved security for the whole of the above concerns which will make it more convenient to purchasers. The title deeds are in the hands of William Hamilton, Attorney in Omagh, where any person may view them that chooses it. There will be some old fashioned plate sold at same time for ready money.

In the Name of God Amen I Elizabeth McCausland Wife of Conolly McCausland of Fruithill in the County of Londonderry being of sound Mind Memory and Judgment & fully authorized by him so to ds Do hereby make this my last Will and Testament in manner following First I recommend my Soul to the Mercy of the Almighty God hoping for a Blessed Resurrection thro the Merits of my Redeemer Jesus Christ and do order my Body to be decently Interred and do dispose of my Worldly Goods as follows Whereas my dear Brother Hodgson Gage of Bellarena in §. County Esq. late decd. made his last Will & Testament and therein bequeath’d all the Lands Tenements & Hereditaments he dy’d Seized of and also all the Church Land Lease he held under the Bishop of Derry to me during my Life Subject to some Annuities & other Incumbrances and after my death Remainder to my Son Robert during his Life & after his death to his Issue Male & failing such Issue to go to my Son Conolly during his Life and after his death to his Issue Male & failing such Issue to go to my Son Marcus during his Life Remainder to his Issue Male & so on to my three daughters severally and their respective True Male and Whereas the said Hodgson Gage by a subsequent Clause in his said Will hav Impowered me by my last Will to grant all §. Lands Tenements & Hereditaments he dy’d Seized of & also the §. Lands he held from the Bishop of Derry to any or either of my §. Will I hereby Nominate & appoint my Son Marcus to Succeed to all the §. Lands of Inheritance to take the Rents & profits of §. Church Lands Lease as they are to accompany the Real Estate and my Will is that my §. Son Marcus & every other person who shall be Seized of an Estate or use for Life in §. Freehold or Leasehold Lands shall be dispunishable of Waste & shall have a power to Settle such a Jointure on a Wife & to Grant Leases of §. Lands of such duration as are directed & appointed by the §. last Will of the §. Hodgson Gage and I do herby Constitute and appoint my §. Brother Hodson became a lapsed Legacy and void Now I Elizabeth McCausland do by this Codicil Leave & bequest an annuity of Twelve pounds to be paid yearly and every year to Elizabeth Gage Mary Gage & Florinda Gage daughters of the §. Robert Gage to be equally distributed among them in Shares of four pounds each during the lives of the §. Elizabeth Mary & Florinda and at the death of any one of them my Will is that the Share belonging to such of them so dying shall cease and fall into my Ex. and that my §. Ex. Shall continue to pay four pounds each ? Annum to the two Surviving daughters and when a second dies her Share to Cease in like manner as the former and four pounds ? am to be paid to the Sole Surviving one during her natural Life I do likewise Leave and bequest to my Cousin Sarah Church Spinster who now lives with me an annuity of Twenty pounds a year during the term of her natural Life. Memorial of an Indenture dated 1st Sept. 1787, made between Alexander McCausland of Omagh, Co. Tyrone, Esq, of the one part and the Rev'd Robt. Heyland, Rector of Colerain, Co. Londonderry, Clk, and Allen Bellingham of the City of Dublin, Esq, of the other part, Whereby said McCausland did grant unto said Heyland and Bellingham one annuity or yearly rent charge of £ 100. to be issuing out of all that and those Upper Cloghfinn, Lower Cloghfinn, Crackecor, Upper Drumnakilly, etc. . . ., To have and hold the said annuity in trust for the purposes therein mentioned. Later comes an indent­ed deed by Margaret, widow of Alexander McCausland of Omagh. This would indicate that the Lt. Alex. McCausland mentioned in the previous deed had married a second time, and therefore tallies with the tradition of the founding of the Donaghanie family.

 

It is said that after several generations a dispute arose concerning the inheritance of the Estate. The father had married a second time and the second wife secured the estate for her sons. The alleged rightful, or disinherited heirs, lacking the funds necessary for a law suit, were unable to substantiate their claims, and were obliged to bid farewell to Drumnakilly and the estate. The disinherited heirs scattered from Drumnakilly. William settled at Donaghanie, Beragh, and founded the family which is traced in the suc­ceeding chapters.

Whereas by indented deed of settlement made on the intermarriage of Marcus Gage with my nice Rachel Jane McCausland alias Gage & by which deed of settlement I have agreed. Certain Freeholds herein mentioned should be settled & reso? the property of them the said Marcus & Rachel & their heirs in manner in said settlement mentioned from & immediately after my decease and in order to make ? Bills, notes or book amounts or any other may at the time of my decease to her & her heirs forever. I so also leave & bequest to my said ? any further and other property together with all residuum or surplus that I may die possessed of and that may not happen to have been mentioned or set forth in this my last will & testament.
