DUNGANNON PETTY SESSIONS
FEBRUARY 2. – Magistrates, R. WRAY and THOMAS GREER, Esq. No petty sessions being held since this day month, in consequence of the Quarter Sessions intervening, an immense of number of cases were on the books, and the court sat from 11 o’clock, A.M., till 6 P.M. The following are the only cases worthy of notice: –
EXCISE CASE. – JOHN LOWRY, of Dungannon, summoned by the Excise for having 125lbs. of paper in his possession which had not paid the Queen’s duty, namely 1½d. per 1b., and 5 per cent on the amount. – MR. LANDRETH, Supervisor, and MR. BAYNHAM, Excise officer and others, were examined on behalf of the Crown. MR. DAVISON, of Moy, Attorney, was on the part of the Excise, and MR. NEWTON, of Dungannon, appeared on the part of Mr. Lowry. He confined his defence to the cross-examination of the witnesses produced on behalf of the Crown, to calling the attention of the court to the different points which he had made in favour of his client, during his cross-examination of the witnesses for the prosecution, and to the law as laid down in similar cases, quoting several authorities. The case was dismissed. The Excise gave notice of their intention to appeal.
