In the case of The Queen V Joseph Donnelly at the Tyrone
Assizes 11
April 1862, Joseph Donnelly submits a challenge to the
array of the
jury panel, to the court. He alleges that names submitted
for Jurors
by the Sheriff of co. Tyrone Samuel Wensley Blackall Esq.
are not
found in the Jury Book of Co. Tyrone or in any Jury Book
(lists of Clerks of the Peace) lawfully in force.
It deemed them more likely to convict than to acquit the
said
prisoner, and because the said panel was so arrayed and
returned by
and through the agency of Charles M'Crossan, Esq. solicitor,
sub-sheriff of the of the said county, John M 'Crossan,
Esq., the
brother of the said Charles M'Crossan, being the attorney
for the next
of kin of the deceased Patrick Hillon, and actively
assisting in the
prosecution, and interested in the conviction of the said
prisoner.
C. C. Davidson is attorney for the prisoner (Joseph
Donnelly)
Joseph Donnelly charged with Manslaughter
Justice Christian found the challenge was well founded and
quashed
the panel for that case.
