This Indenture made the Tenth Day of September in the Year of our Lord God, One Thousand Eight Hundred and Six [10 September 1806 ]

 

BETWEEN Daniel Moore ECHLIN of the City of Dublin, Esquire of the first part AND James BOYLE of DRUMNAFORBE in the County of Tyrone of the other Part, Witnesseth, that the said Daniel Moore ECHLIN for and in consideration of … the yearly Rent and Covenants herein after reserved Hath demised, granted, set and to Farm let, and by these Presents Doth demise, grant, set, and to Farm let, unto the said James BOYLE ALL that and those one undivided Moiety of the Dwelling house, Offices, garden and TAN YARD, now in the possession of Roger O’NEILL under tenant to the said James BOYLE Situate in the town of Drumnaforbe aforesaid, Manor of Hastings & County of Tyrone aforesaid

 

And by Virtue of Bargain and sale to him thereof made by the said Daniel Moore ECHLIN in consideration of 5 shillings ster[ling] by Indenture bearing date the day next before the day of the date of these Presents [i.e.9th September 1806] and by force of the statute for transferring Uses into Possession and to his Heirs And Assigns

To Have And To Hold, the said demised Premises, with the Rights, Members, and Appurtenances thereunto belonging or in anywise appertaining unto the said

James BOYLE his Heirs and Assigns, from the First Day of November last

for and during the natural life and lives of the Rev[eren]d John BOYLE, aged 28 years, Eldest son of the said James BOYLE, Hugh BOYLE and Alexander BOYLE: sons of the said James BOYLE and the survivor and survivors of them and for and during the Natural life and lives of all such other person or persons as shall from time to time forever hereafter be added hereunto by Virtue of, and in Pursuance of Covenants and Agreements hereinafter for that purpose mentioned and Contained the said James BOYLE his Heirs and Assigns

Yielding And Paying therefore and thereout, yearly and every Year during the said Demise unto the said Daniel Moore ECHLIN his Heirs and Assigns the yearly Rent of Five Pounds to be paid by said James BOYLE in two equal Payments, on every first day of May and November in every Year during the said Term over and above all Taxes, Charges, and Impositions whatsoever (Quit Rent and Crown Rent excepted) , the first Payment thereof to be made on the first Day of November next ensuing the Date of these Presents. AND if the said reserved yearly Rent or any Part thereof shall happen to be behind or unpaid by the Space of twenty one Days next after the Days herein before mentioned for the Payment thereof, then and so often as it shall so happen it shall and may be lawful to and for the said Daniel Moore ECHLIN his Heirs or Assigns, into the said demised Premises or any Part thereof to enter and distrain, and the Distress and Distresses then and therefore found, to lead, drive, take away and dispose of according to Law; And if no sufficient Distress or Distresses shall or may be found on the said demised Premises to satisfy the said Rent and all Arrears thereof, then it shall and may be lawful to and for the said Daniel Moore ECHLIN his Heirs or Assigns, into the said demised Premises or any Part thereof in the Name of the Whole to re-enter, and the same to have again, re-possess and enjoy, as in his or their former Estate, any Thing in these Presents contained to the contrary in anywise notwithstanding.

AND the said James BOYLE doth for himself his Heirs and Assigns covenant, promise and agree, to and with the said Daniel Moore ECHLIN his Heirs and Assigns, by these Presents that he the said James BOYLE his Heirs and Assigns, shall and will from Time to Time and at all Times hereafter, during the Term hereby demised, well and truly satisfy, content and pay to the said Daniel Moore ECHLIN his Heirs and Assigns, the said yearly Rent on the said Days and Times herein before mentioned for the Payment thereof, clear above all Taxes as aforesaid.

AND that the said James BOYLE his Heirs and Assigns, shall and will during this Demise, preserve, uphold, support, maintain, and keep the said demised Premises, and all Improvements made and to be made thereon, in good and sufficient Order, Repair, and Condition; And at the End or other sooner Determination of this Demise, shall and will so leave and yield up the same unto the said Daniel Moore ECHLIN his Heirs and Assigns.

And the said Daniel Moore ECHLIN doth hereby for himself his Heirs and Assigns Covenant with the said James BOYLE his Heirs and Assigns

That upon the death of the said John BOYLE, Hugh BOYLE & Alexander BOYLE or any of them which shall first happen(;) upon payment of one shilling by the said James BOYLE his Heirs and Assigns unto the said Daniel Moore ECHLIN his Heirs and Assigns, so that the said James BOYLE his Heirs and Assigns may at all times for Ever hereafter have a term for three lives in being and undetermined in the Premises {rest written on the side} at …d? under the rents and Covenants – herein contained all which deeds of renewal are to be at the proper Costs And Charges of the said James BOYLE his Heirs and Assigns.

AND the said Daniel Moore ECHLIN doth hereby for himself his Heirs and Assigns covenant, promise, and agree to and with the said James BOYLE his Heirs and Assigns, that the said James BOYLE his Heirs and Assigns, paying the said reserved yearly Rent, and performing the Covenants herein before mentioned, shall and may peaceably and quietly have, hold, and enjoy the said Premises, with the Appurtenances, during the Term hereby demised, without any Let, Hindrance, Interruption, or Disturbance of the said Daniel Moore ECHLIN his Heirs or Assigns, or any Person or Persons claiming or deriving from or under him them or any of them.
