This Indenture made the Twenty third day of September in the year of our Lord One Thousand Eight Hundred and Five [ 23rd September 1805 ] between

 

Hugh BOYLE late of DRUMQUIN in the County of TYRONE

but now of DUNGIVEN in the County of LONDONDERRY of the one part

and

Alexander BOYLE of DRUMQUIN aforesaid

BROTHER of the said HUGH BOYLE of the other part.

 

Witnesseth that the said Hugh BOYLE for and in consideration of the natural love and affection he hath for the said Alexander BOYLE

and in consideration of the sum of Four Hundred Pounds Stirling to him in hand paid by the said Alexander BOYLE at or immediately before the Ensealing and delivery of these presents, the receipt whereof he doth hereby acknowledge, and thereof doth release, acquit and discharge the said Alexander BOYLE his heirs, Executors and Administrators for ever by these presents,

Hath Granted bargained sold aliened released confirmed transferred Assigned and made over and by these Presents doth grant bargain sell alien release confirm Transfer Assign and make over unto the said Alexander BOYLE

(in his actual possession now being by virtue of a bargain and Sale to him thereof made by indenture of Lease for one whole year bearing date the Day next before the Day of the date these presents [ i.e. 22nd September 1805 ] and by force and virtue of the statute for transferring uses into possession)

and to his heirs Executors Administrators and Assigns;

 

all that and those the undivided half or proportion of him the said Hugh BOYLE in and to the Several and respective towns and Lands following

to which he the said Hugh BOYLE and his Brother the said Alexander BOYLE were Joined Tenants by a certain Deed of release heretofore to them thereof

MADE BY THEIR FATHER James BOYLE of DRUMQUIN aforesaid,

 

That is to say the said Hugh BOYLE’s share and proportion of one true and Equal individual Moiety:

of the Town and Lands of Upper Kilmore

of the Town and Lands of Drumnaforbe

of the Town and Lands of Upper Caroney (Carony)

and of two Thirds of the Town and Lands of Curraghamulkin

 

together with all and Singular the houses, out-houses, ways, Easements, Rights, Members, and Appurtenances thereunto belonging,

 

together with all the Interest of him the said Hugh BOYLE in and to the Lands of Ardarver

 

with the Growth of the Woods of Collow Donaree (Dunnaree) Drummeny (Drummenagh?) and Drumscraw (Drumscra) all which such said Lands and Premises are Situate lying and being in the Manner [Manor] of Hastings in the County of Tyrone aforesaid.

 

As also all and Singular his the said Hugh BOYLE’s Share and proportion of in and to the respective parts of the Several Towns and Lands of Baravey Drumnamalra Lackagh Killen Mullaghamacks (??) And the Abby land(s) of Carrickaness all which said Towns and Lands with the Appurtenances thereunto belonging are Situate lying and being in the County of Tyrone aforesaid. ???……………….??? And all the Estate Right Title property claim and demand whatsoever of him the said Hugh BOYLE his heirs Executors Administrators or Assigns at law or in Equity in and to the Same, And every part and parcel thereof with all Deeds & or writings concerning said premises or any part thereof, To have and to hold all and singular his the said Hugh BOYLE’s Title and Interest in and to the before mentioned and conveyed Towns and Lands of Upper Kilmore, Drumnaforbe, Upper Caroney, Curraghamulkin, Ardarver, with the growth of the woods of Collow, Donaree (Dunnaree), Drumeny (Drummenagh?), and Drumscraw (Drumscra) with the rights Members and Appurtenances thereunto respectively belonging unto him the said Alexander BOYLE his heirs and Assigns to his and their own proper use and behoof for Ever, and to have and to hold, all and Singular the said Hugh BOYLE’s Titles and Interest in and to the herein before mentioned and Assigned (or intended so to be) towns and Lands of Baravey, Drumnamalra, Lackagh, Killen, Mullaghnamack (??), and the Abbey land(s) of Carrickaness with all and Singular the Rights and Appurtenances thereunto belonging, unto him the said Alexander BOYLE his Executors Administrators and Assigns for and during the rest residue and remainder of the Several and respective terms for years remaining unexpired of the Leases under which James BOYLE: FATHER of the said Hugh and Alexander BOYLE derived his Title in to said Several Towns and Lands with all benefit of renewal to of and concerning the same, and all Deeds or Writings relating thereto;

And (said Indenture contains cov[enants?]) the said Alexander BOYLE doth hereby for him his heirs Executors Administrators & Assigns Covenant promise and agree to and with the said Hugh BOYLE his heirs Executors Administrators and Assigns, That he the said Alexander BOYLE his heirs Executors Administrators and Assigns shall and will, well and truly protect save harmless and Indemnify as well the said Hugh BOYLE his heirs Executors Administrators and Assigns, as all and singular his Title and Interest in and to the Lands of Cloghan and three Tenements and Houses in NEWTOWN LIMAVADDY in the County of Londonderry of from & and against any past Lease(?) or possession(?) to or of the debts of James BOYLE aforesaid, the FATHER of the said Hugh and Alexander BOYLE and also of and from a certain Annuity of Fifty pounds a year charged under a certain deed of the thirty first day of August last [ 31st August 1805 ] on all and Singular the hereby granted and released Lands and Premises for the Joint lives of the said James BOYLE and Jane BOYLE his WIFE, Payable in manner therein mentioned, it being the true intent and meaning of these present and of the Parties hereunto that the said Alexander BOYLE his heirs Executors Administrators and Assigns, for the considerations aforesaid shall take all the Estate Title and Interest of him the said Hugh BOYLE his heirs Executors Administrators and Assigns in and to the Several and respective Towns and Lands conveyed Jointly to them The said Hugh and Alexander BOYLE by James BOYLE their FATHER under the aforesaid deed of the thirty first day of August last [31st August 1805 ] (save and except the Lands of Cloghan and three Tenements and Houses in Newtown Limavaddy in the County of Londonderry) he the said Alexander BOYLE his heirs Executors Administrators and Assigns protecting saving harmless and indemnifying the said Hugh BOYLE his heirs Executors Administrators and Assigns off from and against the Debts and Annuity to which said premises were made subject and liable by said Deed, and that all and every such further and other Acts Deeds and Assurances necessary in the Law for carrying the true intentions of the Parties hereunto into more Full effect shall be made and done such as Counsel learned in the Law shall reasonably advise Devise or require.

 

In Witness whereof said Parties have hereunto put their hands and Affixed their seals the day and year first within above written.
